In the fast-paced world of global immigration, rules are subject to regular changes and new visa categories for workers and visitors are frequently introduced by governments worldwide.

With this in mind, the Global Immigration team at Smith Stone Walters would like to make our clients and followers aware of the following recent updates.

Australia: Changes to the Priority Migration Skilled Migration List

Australia has amended its list of occupations included under the Priority Migration Skilled Occupation List with 41 jobs now included (up from a previous 19). Input from various stakeholders including businesses has led to the change.

For employers with candidates under this list it means that processing and travel exemptions will apply during the visa application process.

USA: USCIS Will Allow Resubmission of Certain FY 2021 H-1B Petitions Rejected or Closed Due to Start Date

For FY 2021, the number of petitions filed during the initial filing period was below the number projected. Therefore, in August 2020, additional registrations that were held in reserve were selected. A number of these petitions listed a start date after 1 October 2020 and were subsequently rejected or closed.

USCIS now confirms that these rejections should not have occurred and they invite resubmissions from those who were rejected. It is noted that the rejection must have been solely for requesting a start date after 1 October 2020.

The deadline for resubmissions is 1 October 2021, with a request to flag the petition as a resubmission accordingly.

UAE: Physical Identity Cards suspended

In the United Arab Emirates, a new card is currently being worked on with additional security features. In the interim, the Federal Authority for Identity and Citizenship has suspended the issuance of physical Identity Cards.

Those who need to apply for a card or obtain a renewal in the meantime can continue to do so by way of a digital version of the card. To make an application, individuals should utilise the ICA UAE Smart mobile phone app.
