3 Questions
to help you partake
in the Tier 2 review

After receiving over 150 submissions of evidence for its review of the minimum salary thresholds for Tier 2 migrants, the Migration Advisory Committee (MAC) is now calling for further evidence regarding its wider review of the Tier 2 system.

The Tier 2 review is examining the potential effects of government proposals which would restrict the number of skilled migrants entering the country to only highly specialised experts and those filling genuine skills shortages.

By submitting your thoughts and responses to these proposals, you will be addressing the business and industry needs of your sponsor organisation whilst influencing the development of the UK’s immigration policy.

It is easy to partake in the Tier 2 review!

Choose the proposal(s) you wish to focus on and answer the corresponding questions.

Proposal: The introduction of a skills levy on sponsor organisations

  • What would be the impact of a skills levy on your business and industry?
  • Should a skills levy be a one-off payment at the point of recruitment or should it be on an annual basis for the duration of the migrant’s stay?
  • Do you think that exceptions should be made for certain occupations and/or sectors?

Proposal: Removing a Tier 2 dependant’s right to work in the UK

  • How many of your Tier 2 employees bring dependants? In which sectors and occupations do they work?
  • Would removing their automatic right to work in the UK affect a Tier 2 migrant’s incentive to come to the UK?
  • Do you feel that this would impact the UK’s economy and public finances?

Proposal: Tightening up the intra-company transfer (ICT) route

  • Which aspects of the rules and operation of the ICT route do you feel could be changed in order to restrict this route and why?
  • Do you agree that there should be tighter restrictions on companies who use the ICT route to outsource contracts with third parties?
  • What impact do you feel would be felt from making ICT migrants subject to the immigration health surcharge?

Please contact your Smith Stone Walters Immigration Advisor by 25 September 2015 with your responses to any of the above proposals, along with any corresponding evidence you may have to back up your views, and we will submit these upon your behalf.

Alternatively, written responses should be sent by the same deadline via email to mac@homeoffice.gsi.gov.uk or via post to: Migration Advisory Committee, 3rd Floor, Seacole Building, 2 Marsham Street, London SW1P 4DF.
